Doctor Liability For Delaying Cancer Detection

Few things trigger such a strong dread as hearing the words breast cancer.  Regardless that with progress in treatment and early diagnosis many women outlive the cancer, it is tough to avoid images of serious weight loss, loss of strength, loss or hair and especially death   Even with early detection breast cancer could still mean the loss of a breast.  When chemotherapy is required the experience can be extreme on the woman

In a number of cases a metastasized cancer might have been found at an earlier stage.  Such early diagnosis would present the patient a considerably better probability of conquering the cancer.  In some instances, it may also have required only a lumpectomy instead of a mastectomy.   Still, now and then the cancer is not detected earlier as a consequence of a doctor’s malpractice.   Maybe the physician thought a lump was only a benign cyst and failed to obtain the tests that would have revealed it was cancer.  Perhaps the doctor failed to screen the woman for breast cancer.  Perhaps the physician incorrectly interpreted a mammogram or a biopsy.  No matter what the error, the outcome in delayed diagnosis cases can be tragic.

A lawyer experienced in handling cancer malpractice routinely is approached about what are normally called delayed diagnosis claims.  These cases happen because a physician fails to properly diagnose a patient’s cancer either due to the fact the physician disregards the individual’s symptoms or fails to use the proper screening guidelines.  The leading cancers with which failure to screen claims come up are: prostate cancer, breast cancer, colon cancer, and cervical cancer.  These are cancers for which there exist screening tests that can, oftentimes, find the cancer before the patient has any symptoms.
